Route (c)(8) (Pending asylum application): we review applicable form questions with mechanical checks of format, dates and consistency. We do not decide eligibility, read your documents or verify evidence. That remains your responsibility.
Rule set i765-renovacion-adulto-v1.2.0.
Route (c)(8) — Pending asylum application
Context taken from the cited official sources. We do not verify these points for you nor do we decide your eligibility.
Category (c)(8) corresponds to those who have a pending asylum application (Form I-589) and are requesting a work permit based on that pending application.
What to have on hand
- Both sides of your previous EAD: it contains the category, A-Number, and expiration date.
- Evidence that your asylum application remains pending, pursuant to the (c)(8) section of the official instructions.
- Your current mailing address, the one you use to reliably receive mail from USCIS.
What official sources say about this route
- The official instructions have a specific section for this path, "Special Filing Instructions for Those With Pending Asylum Applications--(c)(8)": it lists the conditions and evidence requested by USCIS.
- The category is entered in Item Number 27 of the form, within Part 2.
- Item Number 30 asks, only for (c)(8), if you have ever been arrested for or convicted of any crime.
- If you answer "Yes" to Item Number 30, the instructions refer to the (c)(8) section to determine which court dispositions to include. This is a point where authorized legal help is recommended.
- There is a separate provision for asylum applications under the ABC settlement for individuals from El Salvador and Guatemala.
- Having a pending asylum application is not the same as qualifying: USCIS decides, not SettleWise.
- The 150-day wait you may have heard of applies to the initial work permit application, not a renewal requirement.
- The (c)(8) rules do not apply to (c)(9) and vice versa.
Route coverage: the checks we run are common to (c)(8) and (c)(9); there are no specific checks yet for (c)(8).
- Official Instructions for Form I-765, edition 08/21/25 (PDF) — consulted on 2026-10-21. Sections regarding the eligibility category and evidence to be submitted with the form.
Form edition
SettleWise handles the form edition and checks the official USCIS edition notice. You don’t need to verify the edition yourself.
