Route (c)(9) (Ajuste de estatus pendiente (Formulario I-485)): we review the form questions that apply to your case, with mechanical checks for format, dates, and consistency. We do not decide if you qualify, we do not read your documents, and we do not check your evidence: that remains your responsibility.

Rule set i765-renovacion-adulto-v1.2.0.

Route (c)(9) — Pending Adjustment of Status (Form I-485)

Context taken from the cited official sources. We do not verify these points for you nor do we decide your eligibility.

Category (c)(9) corresponds to those who have a pending adjustment of status under section 245 of the INA (Form I-485) and are requesting a work permit based on that pending adjustment.

What to have on hand

  • Both sides of your previous EAD: it contains the category, A-Number, and expiration date.
  • The receipt notice for your Form I-485, or other evidence that the adjustment remains pending, if filing separately.
  • Your current mailing address, the one you use to reliably receive mail from USCIS.
What official sources say about this route
  • Instructions indicate filing the I-765 together with Form I-485 or, if filed separately, enclosing a copy of the I-485 receipt notice or other evidence that it remains pending.
  • For this path, the instructions state that copies of Form I-94, passport, or travel document for Item 3.A are not required.
  • The category is entered in Item Number 27 of the form, within Part 2.
  • If your I-485 was filed before an immigration court (EOIR), the instructions require proof that proceedings are ongoing, that the I-485 was properly filed with the court, and that it remains pending.
  • Within (c)(9), there is a distinct provision for physicians with a National Interest Waiver, which requires evidence of meaningful progress toward their obligation.
  • The instructions warn that asylees or refugees adjusting status should file under (a)(5) or (a)(3), not under (c)(9).
  • We do not carry over any asylum-specific deadlines or requirements to (c)(9): they are distinct categories.
  • The list USCIS publishes for (c)(9) is optional, dated 04/01/2024, and does not replace the current form's instructions: it includes current mailing address, complete sections, signature and date, correct fee if applicable, Form G-28 if represented, proof of pending I-485, certified translations, proof of identity, and photographs.

Route coverage: the checks we run are common to (c)(8) and (c)(9); there are no specific checks yet for (c)(9).

A text summary with your data and checks. It is an optional supplement: it is not Form I-765 and is not submitted to USCIS.
